Thank you for choosing Creative Confections by KLE. By placing an order with us, you agree to the following terms and conditions:

 

1. Cottage Food Operation Disclosure

All products are made in a home kitchen that is not inspected by the Department of State Health Services or any local health department. Items may contain or come into contact with common allergens including, but not limited to: eggs, milk, soy, peanuts, tree nuts, and wheat.

2. Payments & Booking Policy

To reserve client event date and begin preparing client custom order, the following payment terms apply:

• Minimum Order Requirement: A $120 minimum is required for all custom orders.

• Retainer: A 50% non-refundable retainer is due within 72 hours of receiving the invoice to confirm client order. Client date is not secured on the calendar until this retainer is received.

• Holiday Orders: Orders scheduled between November 22–30 or during the entire month of December must be paid in full within 24 hours of receiving client invoice due to high seasonal demand.

• Final Balance:

  • For general orders, the final payment is due no later than 7 days prior to the pickup or delivery date.

  • For weddings and large-scale dessert tables, final payment is due 14 days prior to the event.

• Late Bookings:

  • Orders placed within 15 days of the event date are considered rush orders and must be paid in full by the due date listed on the invoice.

  • A $65 Rush Fee applies and is required to begin the order.

 

• Order Cancellation Due to Non-Payment: If payment is not received by the deadline listed on client invoice, client order will be canceled, and client date may be released to other clients. No exceptions will be made.

• Client Responsibility: It is the client responsibility to review all details (design, size, flavor, date) listed on the invoice prior to submitting payment. Submitting payment confirms agreement with the invoice and these terms.

3. Rush Fee Policy

Orders placed with less than 14 days’ notice before the event date are considered rush orders and will incur a $65 Rush Fee (also referred to as a Miracle Fee).

• All rush orders must be paid in full at the time of booking.

• Rush orders are subject to availability and cannot be guaranteed until confirmed by Creative Confections by KLE.

4. Changes & Cancellations

• The final payment due date is also the last day to make changes to client order, including event date, size, flavors, or design.

• Cancellations after the balance due date are not eligible for a refund.

• In the rare event Creative Confections by KLE is unable to fulfill client order due to an emergency, a full refund will be issued.

5. Refund & Credit Policy

• Creative Confections by KLE does not offer refunds under any circumstance, including dissatisfaction with design, flavor, or service.

• Store credit may be issued at our discretion for use toward a future order if cancellation occurs before the final balance due date.

6. Artistic License & Design Policy

We reserve the right to use creative discretion when executing client order to ensure structural, visual, and design integrity.

• Creative Confections by KLE does not replicate or duplicate designs from other bakers. Inspiration photos may be used as a reference, but client design will be customized to reflect our unique style and artistic interpretation.

7. Delivery & Pickup

Creative Confections by KLE offers both pickup and delivery options, except where otherwise required:

• Orders under $500: Clients may choose pickup or delivery

• Orders $500 or more: Delivery is required

• Dessert tables: Delivery and setup is required regardless of order amount

Delivery Fees:

• $40 flat rate for the first 20 miles from Waldorf, MD (20602)

• $1.20 per mile beyond 20 miles

• Tolls will be added if applicable

Pickup orders must be retrieved at the agreed-upon time by the client or their representative. Once items leave our possession, Creative Confections by KLE is not responsible for any damage due to handling, transport, or storage.

8. Cake & Dessert Care Instructions

• Refrigerate cakes and treats immediately. Ideal storage temperature is 70°F or below.

• Cakes with buttercream should be removed from refrigeration 2 hours prior to serving.

• Improper storage, handling, or environmental conditions voids all guarantees of product integrity or food safety.

9. Allergy Disclaimer

Products may contain or come into contact with common allergens. It is the client’s responsibility to communicate these risks to their guests. Creative Confections by KLE is not liable for allergic reactions.

10. Payment Processing Fee

A 4% processing fee applies to all electronic transactions.

11. Legal & Dispute Protection

By submitting payment, you affirm agreement to these terms and assume full responsibility for the order.

• All sales are final. Refunds will not be issued due to taste, design style preferences, event changes, or missed pickups.

• The client is responsible for reviewing all order details and ensuring accuracy before finalizing payment.

• Chargebacks initiated after services have been rendered, or for services documented in writing and completed according to agreement, will be contested with supporting documentation including signed agreements, order photos, invoices, text/email communication, and delivery confirmation.

• You agree not to dispute charges with client bank or credit card company without first attempting to resolve the issue directly with Creative Confections by KLE.

• In the event of a credit card dispute or chargeback, the client shall be liable for all fees incurred by Creative Confections by KLE, including bank fees, dispute fees, and legal costs.

By placing an order with Creative Confections by KLE, you confirm that you have read, understand, and agree to abide by all terms listed above. You further accept full responsibility for the accuracy of client order, payment obligations, product care, and all outcomes related to service use.
